Ronndale Esporlas filed the lawsuit in Santa Clara County. The lawsuit claims Smith and former 49ers' tight end Delanie Walker repeatedly and illegally fired weapons on numerous occasions during the June 2012 party

Smith and his friends also charged $10 per person to enter the party, according to one of the victims.

Smith was stabbed at the party held in the East San Jose foothills.

The lawsuit also claims Smith and Walker consumed significant quantities of alcohol and were legally intoxicated. It also said the players knew the handguns were illegally possessed.

Smith and Walker appeared on the balcony of Smith's home to try and end the party and began to fire shots into the air, according to the lawsuit.

The lawsuit claims Walker then made his way to the driveway where he allegedly fired more shots into the air and toward others attending the party.


Smith's attorney was contacted Tuesday by NBC Bay Area but declined comment citing pending litigation.

Wow more players with guns. If there is truth to this, I'm sure Smith and Walker will be heavily suspended given the Hernandez situation.

Clearly needs to be taught a lesson. Suspend him for the season without pay and reevaluate him next season. Cmon Roger, flex your guns.

Literally the same thing I thought when that initial Hernandez civil suit was leaked to deadspin. I'm sure there is more to this story and it's probably not going to end well for these two.

Also this is a civil suit not a criminal suit.

Goodel will suspend them for firing the guns most likely just to seem tough on firearms after Hernandez. Even if the civil suit is bull

... I have no idea whether the accusations are true obviously but this time period is pretty typical for a tort claim. First you need to find a lawyer you want to hire and there are a multitude of options, secondly the lawyer is likely to run his own investigation prior to any charges to gather as much evidence as possible. Finally, for high profile cases there are settlement negotiations prior to a lawsuit to see if a the celebrity will payout to avoid publicity. Finally, the Lawyer is going to make damn sure his initial pleadings are perfect and depending on the lawyer may be comfortable using quite a bit of the statute of limitations.

Wasn't there a guy who was shot in the face and hand by Hernandez a few years back that only surfaced right around the death of Odin Lloyd? Or that double homicide in the Boston area that Hernandez was linked to?

Not TOO far fetched to think this took a while to see the light of public.

None of us know if the story is even true. Why wait over a year to file a lawsuit?

Not sure what that means exactly but on the video in the link in the OP they said that the case was actually "covered up for more than a year."
