I don't have any basis for this other than what seems to be common sense, but if they're getting the $2.5M in cash back, then it would seem that they will never pay the $1.35M that was deferred, so they should in theory get the full $3.85M in cap room back. Waiting for someone in the media to confirm or deny this.

So this affects the cap, how? I could really care less if Bob Kraft gets 2.5 million, it does not increase the amount of money they get to spend this offseason.

They are definitely getting $2.5M cap room, and it seems logical to me that they should get $3.85M in cap room.

I was disappointed that the title of this post is inaccurate.

Getting the $2.5M back would have been nice. Winning the opportunity to pursue the money is far less interesting.

So forgive my non-Law background. Has the Fanene case just been thrown out. Did we try and fail to recover both actual money and cap room? What does the future hold with this money?

I think this was one of the under the radar Patriot stories this off-season. $3.85m of cap space would be invaluable at the minute.
