Are we even sure the 'assault' charge came from actually punching the cop, or might it just have been from slapping the cuffs away? Seems to me that if a guy like Dennard hit you, it'd leave a mark. _________________

Assault is the single most ridiculous charge that gets made. Assault starts at the very bottom with touching. If I accidently touch someone getting off the train, that is, according to the law, assault.
It gets the stigma of being a punch or a slap, but most of the time it's just PC gone crazy. _________________

The problem was the case against him wasn't necessarly good. The witnesses had different stories than the cop. The video didn't show anything. And the fact that the Cop said Dennard hit him didn't produce any cuts or bruising. All seemed weak to me. Personally I thought he would have just been found guilty of resisting. |
If that story is true, then it proves further how the American Judicial system is terrible.

Does anyone know what the earliest the jail term would begin (assuming he can't postpone it) if he gets 180 days? Immediately after sentencing or what? _________________

I am willing to bet that the "assault" was Dennard assaulting the cops fist with his face. I've seen it so many times that assault could boil down to anything, as others have eluded to.
